To settle difficulties and obstacles related to real estate projects in some big provinces/cities, on 20 February 2025 the National Assembly of Vietnam issued Resolution170/2024/QH15.
Resolution 170 with an effective date of 1 April 2025, provides a variety of mechanisms and policies to clear the way for projects to proceed with implementation. These may include:
(i) For the land use rights certificates (LURC) that violate the land-use term for business production land in Da Nang: The land-use terms in the LURC may be adjusted to 50 years.
(ii) For continued use of land, determining land prices, and calculating land use fees and land rental fees applicable to a list of projects in Da Nang, Ho Chi Minh City, and Khanh Hoa Province: The procedures related to land, investment, construction, environment, and forestry of such projects will be reviewed by the authorities accordance with the current laws. Projects that meet legal requirements will be allowed to continue. In addition, investors must fulfill applicable financial obligations, including land use fees and land rental payments, which will be reassessed and collected based on the land price tables applicable in Da Nang, Ho Chi Minh City, and Khanh Hoa Province at the time of the land allocation or land lease decision. Projects that do not meet the conditions will have their land revoked.
Since the projects mentioned in Ho Chi Minh City, Da Nang and Khanh Hoa are normally big projects, it is expected that Resolution 170 would help to implement their projects smoothly.
On a separate note, the Government is gathering comments on a draft decree according to which land rentals will be reduced by 30% for the year of 2025 to support the economic growth in Vietnam targeting 8% in 2025.
